River Cities Bank Online Banking Agreement and Disclosures

1. ACCEPTANCE

This agreement details the terms and conditions you accept to be bound by when you use our Online Banking services. This agreement does not supersede or replace any prior agreements between you and River Cities Bank, for accounts you have with us or any other services you obtain from us, but is an additional agreement expressly related to your Online Banking transactions. You must follow all of our instructions and procedures applicable to the services covered by this agreement.

The terms "you" and "your" mean each person who establishes an Online Banking Customer Account with us or who uses or is authorized to use an Online Banking access ID and password or other means of access we establish or approve. "Online Banking" means our service that allows you to: transfer funds from one account to another, access account information, and perform various other functions over the Internet by using your personal computer.

2. REQUIREMENTS & CUSTOMER USAGE

(a) Access ID and Password  

As a first time user of Online Banking, you will establish your access ID and password on site at one of the River Cities Bank locations. It is recommended that you change your password the next time you log on to Online Banking; you will be prompted to change your password on a regular basis thereafter to further protect yourself.

If you provide your access ID and password or other means of access to any other person, they will have full access to your account information. Any loss you experience due to the sharing of this information will be your responsibility.

(b) Transactions you can perform using Online Banking
You, or someone you have authorized to access your accounts by virtue of you providing them your access ID and password, can perform the following transactions using Online Banking:

  • Make transfers between your accounts to the extent authorized:

1.       Transfer between deposit accounts

2.       Transfer to a loan account to make a payment

3.       Advance loan funds on a revolving line of credit

  • Inquire into account information for:

1.       Balance information

2.       Interest paid information

3.       Statements detailing activity

(c) Limits on Online Banking transactions
You must have enough available money or credit in any account from which you instruct us to make a transfer. You can not transfer money from any deposit account requiring two or more signatures for a withdrawal. If any of your qualifying accounts are money market accounts or savings accounts, certain types of withdrawals from those accounts, including transfers, are limited to a total of no more than six in any statement period. The types of withdrawal subject to this limitation are pre-authorized or automatic transfers. Money market accounts allow only three of the six withdrawals to be made by: check, draft, debit card, or similar payment devices where the payments are made to a third party. The above limitations are clearly spelled out in the initial account disclosures you received when you opened your accounts. Please feel free to request another copy if you would like one.

(d) Fees
There are no fees related to our Online Banking package at this time. If we add an online bill pay function, fees for that service will be disclosed to you at that time. We also will charge for stop payment requests and all other charges related to specific types of deposit products and services in the initial disclosures you received when you opened your accounts.

(e) Security
All transactions occur on a secure server which uses firewalls and encryption programs to ensure security for your transactions. A user will automatically be logged out of the online connection after 10 minutes of inactivity. A user will automatically be locked out after three incorrect password attempts. River Cities Bank will monitor periodically for unusual activity. River Cities Bank Online Banking limits access to only accounts that you own. You may not transfer money out of the bank or to an account owned by another person.

(f) Privacy
River Cities Bank respects your privacy and does have a privacy statement. You can view this statement at www.RiverCitiesBank.com. You can also obtain a current copy by calling (715) 422-1100.

(g) Termination
River Cities Bank reserves the right to terminate your Online Banking services at anytime and for any reason. If you wish to cancel your Online Banking services please contact us at River Cities Bank (715) 422-1100.

(h) Support
River Cities Bank cannot support online users with any issues regarding: hardware, software, or browser. Please contact the manufacturer or authorized dealer of the product in question. Refer to the materials in the product package for the contact numbers for these various products.

3. TERMS OF AGREEMENT

River Cities Bank reserves the right to change this Agreement and Disclosure statement. Unless an immediate change is necessary to maintain or restore the security of an account or system, we will mail or deliver a written notice to you at least 30 days before the effective date of any change in a term or condition that would result in:

  • Increased fees
  • Increased liability
  • Fewer types of available services
  • Stricter limitations on the frequency or dollar amount of transfers

 If we make an immediate change that will not jeopardize the security of an account or system, we will notify you in writing on or with the next regularly scheduled periodic statement or within 30 days of making the change permanent. You may always obtain the most recent copy of this agreement at www.RiverCitiesBank.com or by calling (715) 422-1100 to request to have a copy sent to you.

4. ELECTRONIC FUNDS TRANSFER DISCLOSURE

Indicated below are types of Electronic Fund Transfers we are capable of handling, some of which may not apply to your account. Please read this disclosure carefully because it tells you your rights and obligations for the transactions listed. You should keep this notice for future reference.

(a) Preauthorized Credits. You may make arrangements for certain direct deposits to be accepted into your checking, savings, or insured money market account(s).

(b) Preauthorized Payments.
You may make arrangements to pay certain recurring bills from your checking, savings, or insured money market accounts(s). ATM Card Transfers – Mastercard, Discover/Novus, Plus, Cirrus, and Pulse networks - types of transfers, frequency and dollar limitations, and charges - You may access your account(s) using your ATM Card and personal identification number or River Cities Check Card and personal identification number to:

  • Make deposits to checking or savings account(s)
  • Get cash withdrawals from checking or savings account(s)

1.       You may make no more than ten withdrawals per day

2.       You may withdraw no more than $400 per day

  • Transfer funds from savings to checking account(s)
  • Transfer funds from checking to savings account(s)
  • Get information about:

1.       The account balance of your checking or savings account(s)

Transactions governed by this disclosure are subject to change as defined in the Account Terms and Disclosures and Schedule of Common Fees. Some of these services may not be available at all terminals. Please also see limitations on frequency of transfers section regarding limitations that apply to ATM transfers.

(c) Types of River Cities Check Card Point-of Sale Transactions. You may access your checking account(s) to purchase goods (in person or by phone), pay for services (in person or by phone), get cash from a merchant, if the merchant permits, or from a participating financial institution, and do anything that you can do with a credit card (that a participating financial merchant will accept with a credit card).

(d) Point - of - Sale Transactions.
Frequency and dollar limitations, and charges - using your card:

  • You may make no more than ten transactions per day
  • You may not exceed $1,000 in transactions per day
  • The charge for you card (whether or not the card is used in the period) is $5 per year

(e) Limitations on Frequency of Transfers.
In addition to those limitations on transfers elsewhere described if any, the following limitations apply:

  • For security reasons, there are other limits on the number of transfers you can make by ATM.
  • For security reasons, there are other limits on the number of transfers you can make by debit card.

(f) River Cities Bank Fees.
We do not charge for direct deposits to any type of account

  • We do not charge for preauthorized payments from any type of account

Except as indicated elsewhere, we do not charge for these electronic fund transfers.

(g) Notice Regarding ATM Fees by Others.
If you use an automated teller machine that is not operated by us, you may be charged a fee by the operator of the machine and/or by an automated transfer network.

(h) Documentation.

  • Terminal transfers. You can get a receipt at the time you make any transfer to or from your account using one of our automated teller machines or point-of-sale terminals.
  • Preauthorized credits. If you have arranged to have direct deposits made to your account at least once every 60 days from the same person or company, the person or company making the deposit will tell you every time they send us the money and/or, you can call us at (715) 422-1100 to find out whether or not the deposit has been made.
  • Periodic Statements. You will get a monthly account statement from us for all checking accounts and statement savings accounts with activity. You will get a monthly account statement from us for your statement savings accounts, unless there are no transfers in a particular month. In any case you will get a statement at least quarterly

For passbook accounts, since the only possible electronic transfers to or from your account are preauthorized credits, we may send only periodic statements. You may bring your passbook to us and we will record any electronic deposits that were made since the last time you brought in your passbook.

(i) Preauthorized Payments

  • You have the right to stop preauthorized payment from your account(s). If you have told us in advance to make regular payments out of your account, you can stop any of these payments by:

We must receive your request 3 business days or more before the payment is scheduled to be made. If you call, we may also require you to put your request in writing and get it to us within 14 days after you call. We will charge you $15 for each stop-payment order you give.

  • If these regular payments may vary in amount, the person you are going to pay will notify you 10 days before each payment, when it will be made and how much it will be. (You may choose instead to get this notice only when the payment would differ by more than a certain amount from the previous payment, or when the amount would fall outside certain limits that you set.
  • If you order us to stop a preauthorized payment three business days or more before the transfer is scheduled, and we do not do so, we will be liable for your losses or damages.

(j) Liability for failure to make transfers
If we do not complete a transfer to or from your account on time or in the correct amount according to our agreement with you, we will be liable for your losses or damages. However, there are some exceptions. We will not be liable, for instance:

  • If, through no fault of ours, you do not have enough money in your account to make the transfer.
  • We reverse a payment or transfer because the account had insufficient funds.
  • You have not given us complete, correct or current account numbers or other information required to complete the payment, credit, transfer or other transaction.
  • Your equipment wasn't operating properly when you attempted to conduct the transaction.
  • Our equipment wasn't operating properly when you attempted to conduct the transaction and it should have been apparent to you at the time.
  • You do not properly follow our instructions, fail to promptly inform us of any inaccurate information about which you became aware.
  • You do not schedule payments or transfers within the time periods set forth in this agreement and a payee does not receive the payment or transfer on or before its due date.
  • You do not request a stop payment within the time period set forth in this agreement and the payment is completed.
  • The account balance is subject to legal process or the claims that restrict the payment, transfer, or other transaction from being complete.
  • If you have an overdraft line and the transfer would go over the credit limit. · If the automated teller machine where you are making the transfer does not have enough cash.
  • If the terminal or system was not working properly and you knew about the breakdown when you started the transfer.
  • If circumstances beyond our control (such as fire or flood) prevent the transfer, despite reasonable precautions that we have taken.
  • There may be other exceptions stated in our agreement with you.

5. CONFIDENTIALITY

We will disclose information to third parties about your accounts or the transfers you make:

  • Where it is necessary for completing transfers; or
  • In order to verify the existence and condition of your account for a third party, such as a credit bureau or merchant or in order to comply with government agencies or court orders
  • If you give us written permission.

6. UNAUTHORIZED TRANSFERS

(a) Consumer liability for ATM/Check Card. Generally, tell us at once if you believe your card and/or code has been lost or stolen. Telephoning is the best way to minimize your losses. You can lose no more than $50 if you give us notice of a lost or stolen card and/or PIN for the card. If you do not give us notice of a lost or stolen card and/or code you will be liable for the lesser of 1) $50 or 2) the amount of any money, property, or services obtained by unauthorized use of the card and/or code before you gave us notice.

(b) Consumer liability for Online Banking. Generally, tell us at once if you believe your access ID or password has been lost or stolen, or that an unauthorized transfer has occurred or may occur. Notifying us by telephone is the best way to minimize your losses. It is possible to lose all of the money in your account(s) as well as any overdraft line of credit.

If you notify us within two business days after learning of the loss or theft of your access ID or password, you will lose no more than $50 if someone used your access ID or password without your permission. If you do not notify us within two business days after you learn of the loss or theft of your user code or password, and if we can prove we could have stopped someone from using your access ID or password without your permission if you had told us, you could lose up to  $500 if someone used your access ID or password.

Also, if your statement shows transfers that you did not authorize, you must notify us at once. If you do not tell us within 60 days after the statement was mailed to you, and we can prove that we could have prevented the loss of funds resulting from the unauthorized transfers, you may not be able to collect the money lost after the initial 60 day period. This applies to both ATM and Check Card, as well as Online Banking transactions.

If a good reason (such as a long trip or a hospital stay) kept you from telling us, we will extend the time period.

(c) Additional Limits on Liability for River Cities Bank Check Card, when used for point-of-sale transactions. You will not be liable for any unauthorized transactions using your River Cities Bank Check Card, when used for point of sale transactions, if: 1) you can demonstrate that you have exercised reasonable care in safeguarding your card from the risk of loss or theft, 2) you have not reported to us two or more incidents of unauthorized use within the prior twelve-month period, and 3) your account is in good standing. If any of these conditions are not met, your liability is the lesser of $50 or the amount of money, property, labor, or services obtained by the unauthorized use before notification to us. Unauthorized use means the use of your debit card by a person, other than yourself, who does not have actual, implied, or apparent authority for such use, and from which you receive no benefit.

(d) Contact in the event of unauthorized transfer. If you believe your card, code, or access ID and/or password has been lost or stolen, or that someone has transferred money from your account without your permission, call or write us immediately at the telephone number or address listed above.

7. ERROR RESOLUTION NOTICE

In case of Errors or Questions About Your Electronic Transfers:
Call or write us at the telephone number or address listed above, as soon as you can. If you think your statement or receipt is wrong or if you need more information about a transfer listed on the statement or receipt, we must hear from you no later than 60 days after we sent the FIRST statement on which the problem or error appeared. 1) Tell us your name and account number; 2) Describe the error or the transfer you are unsure about, and explain as clearly as you can why you believe it is an error or why you need more information; 3) Tell us the dollar amount of the suspected error. If you tell us orally, we may require that you send us your complaint or question in writing within 20 business days.

We will determine whether an error occurred within 20 business days (45 business days if the transfer involved a new account) after we hear from you and will correct any error promptly. If we need more time however, we may take up to 45 days (90 days if the transfer involved a new account, a point-of-sale transactions, or a foreign-initiated transfer) to investigate your complaint or question. If we decide to do this, we will credit your account within 10 business days for the amount you think is in error, so that you will have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within 20 business days, we may not credit your account. Your account is considered a new account for the first 30 days after the first deposit is made, unless each of you already had an established account with us before this account is opened.

We will tell you the results within three business days after completing our investigation. If we decide that there was no error, we will send you a written explanation. You may ask for copies of the documents that we used in our investigation.

8. INTERNET FRAUD AND ONLINE SECURITY

(a) Internet Scams. As a customer of River Cities Bank, the privacy and security of your personal and account information is extremely important to us. By practicing good security habits, you can help us ensure that your private information is protected. Following is a brief description of current online criminal activity:

  • Spoofing. A spoof refers to a hoax or imitation. A spoofed email is an email that appears to have come from a trusted source and requests personal information. A spoofed Web site is an imitation site that uses the exact graphics, colors and layout from the trusted site it is trying to imitate.
  • Phishing. In the computer world, phishing is the act of tricking someone into giving up their confidential information. Often a spoofed email is used to request personal information or as bait to lure someone to an imitation of a legitimate site.
  • Pharming. Pharming is a method criminal hackers use to redirect Internet traffic from a legitimate Web site to a different, identical-looking site (spoofed site) in order to trick the user into entering their personal information onto the fake site. Pharming is more dangerous than phishing, since the user can be redirected to a false site without any participation or knowledge on their part.

(b) Your Password. We will be entitled to act on all instructions received under your password. Since your password is used to identify you as an authorized user of Online Banking, you agree to notify us immediately if the secrecy of your password is compromised, and you also agree not to reveal your password to any person. The security of your personal and account information depends upon maintaining the secrecy of your password. You may change your password at any time while you are using Online Banking.

Immediately report a compromised password to River Cities Bank at 715-422-1100 or toll free at 1-877-525-7155.

(c) Multifactor Authentication. To protect the privacy and security of your personal information, River Cities Bank has implemented Multifactor Authentication (MFA) to the Online Banking system. MFA verifies your identity in two ways: Every time you log in to Online Banking, our system identifies you and the computer from which you are logging on, and it lets you identify the bank’s Web site using a private image and pass phrase.

(d) Your Computer. You agree to be fully responsible for the installation, maintenance, and operation of your computer and software. We are not responsible for any errors or failures from the malfunction of your computer, software, or for any computer virus or related problems associated with the use of an online system. If you are accessing Online Banking through the Internet, you will be responsible for contracting with your own Internet Service Provider ("ISP"). You must also meet the minimum browser requirements set forth on our Web site.

River Cities Bank Online Bill Pay Agreement and Disclosures

This is your bill paying agreement with River Cities Bank. You may use River Cities Bank Online Bill Pay to direct River Cities Bank to make payments from your designated checking account to the Payee(s) you choose in accordance with this agreement. The terms and conditions of the Agreement are in addition to the Account agreements, disclosures, and other documents in effect from time to time governing your Account (the Account Rules).

"You" or "your" means each person who is authorized to use the service. "Payee" means anyone, including the Financial Institution, you designate and the Financial Institution accepts.

PAYEES

The following payments are prohibited through Online Bill Pay:
1) Payments to merchant outside the United States
2) Payments to tax authorities or government and collection agencies
3) Payments to security companies such as Ameritrade for stock purchases or trade taxing authorities
4) Court directed payments (Alimony, child support, or other legal debts)
5) Payments exceeding $10,000

The Financial Institution is not responsible if a Bill Payment can not be made due to incomplete, incorrect, or outdated information provided by you regarding a Payee or if you attempt to pay a Payee that is not on your Authorized Payee list.

2. THE BILL PAYING PROCESS
The Financial Institution will process variable payments on the business day (generally Monday through Friday, except holidays) you designate the bill is to be processed, provided the payment request is received prior to the cut-off time set by the Financial Institution, which is currently 3:00 p.m. CST. Variable bill requests received after the business day cut off time or at any time on a non-business day will be processed on the next business day. The Financial Institution reserves its right to change the cut-off time by giving you notice if it changes.

FOR RECURRING PAYMENT REQUESTS, IF YOU DESIGNATE A PROCESSING DATE OF THE 28TH THROUGH THE 31ST OF A MONTH AND THIS DATE FALLS IN A SHORT MONTH, PROCESSING WILL BE INITIATED ON THE FIRST BUSINESS CALENDAR DAY OF THE MONTH FOLLOWING THAT DATE. Otherwise, recurring payment requests will be processed on the dates you have designated, unless such date falls on a non-business day resulting in your payment being processed on the next business day.

YOU MUST ALLOW AT LEAST FIVE (5) BUSINESS DAYS, PRIOR TO THE DUE DATE, FOR EACH BILL PAYMENT (RECURRING OR VARIABLE) TO REACH THE PAYEE. IT IS THE RESPONSIBILITY OF THE SUBSCRIBER TO SCHEDULE/ACTIVATE RECURRING PAYMENTS. IT IS OUR RECOMMENDATION THAT ADDITIONAL DAYS BE ALLOWED FOR PAYMENTS TRAVELING MORE THAN FOUR STATES AWAY.

You agree to have available and collected funds on deposit in the account you designate in amounts sufficient to pay for all Bill Payments requested, as well as any other payment obligations you have to the Financial Institution. The Financial Institution reserves the right, without liability, to reject or reverse a Bill Payment if you fail to comply with this requirement or any other terms of this agreement. If you do not have sufficient funds in the Account and the Financial Institution has not exercised its right to reverse or reject a Bill Payment, you agree to pay for such payment obligations on demand. You further agree that the Financial Institution, at its option, may charge any of your accounts with the Financial Institution to cover such payment obligations.

Any Bill Payment can be changed or canceled, provided you access the Service prior to the cut-off time on the business day prior to the business day the Bill Payment is going to be initiated.

A maximum amount of any single bill payment cannot exceed $10,000.

3. LIABILITY

(a) Your Liability for Authorized Transactions
You are liable for all transactions that you make or authorize, even if the person you authorize exceeds your authority. If you have given someone your access codes and want to terminate that person's authority, you must notify us that transactions by such a person are no longer authorized. We may have to change your access codes or take additional steps to prevent further access by such person.

(b) Notify us IMMEDIATELY for Unauthorized Transactions
Tell us AT ONCE if you believe your access codes have been lost, stolen or otherwise compromised or used without your authorization. Quickly telephoning us is the best way of reducing your possible losses. You could lose all the money in your account (plus your maximum overdraft line of credit).

 (c) Your Liability for Unauthorized Transactions
If you tell us within two business days after you learn of the loss or theft of your access codes involving a consumer account, you can lose no more than $50.00 if someone used them without your authority.

If you do NOT tell us within two business days after you learn of the loss or theft of your access codes, and we can prove that we could have stopped someone from using them without your authority if you had told us, you could lose as much as $500.00.

Also, if your statement for a consumer account shows payments covered by this agreement that you did not make or authorize, tell us at once. If you do not tell us within 60 days after the statement was mailed to you, you may not get back any money lost after the 60 days if we can prove that we could have stopped someone from taking the money if you had told us in time. If a good reason (such as a long trip or hospital stay) kept you from telling us, we will extend the time periods.

These charges will only be assessed if you request one or more of the services listed here. There will be NO Charges for any items if needed to correct a Financial Institution error.

River Cities Bank reserves the right to charge you for research time involving payments no longer available in your screen history. You will be informed of any such charges before they are incurred.

Bill payments are processed by Electronic Fund Transfers (EFT). Please see the Electronic Fund Transfers Disclosure Statement included, or received when you opened your account, which discloses important information concerning your rights and obligations.  

5. AMENDMENT
The Financial Institution has the right to change this Agreement at any time by notice mailed to you at the last address shown for the Account on the Financial Institution's records, by posting notice in branches of the Financial Institution, or as otherwise permitted by law.
 

6. TERMINATION
The Financial Institution has the right to terminate this Agreement at any time. You may terminate this Agreement by written notice to the Financial Institution. The Financial Institution is not responsible for any fixed payment made before the Financial Institution has a reasonable opportunity to act on your termination notice. You remain obligated for any payments made by the Financial Institution on your behalf.

7. PRIVACY POLICY
(a) Your Privacy is Important to River Cities Bank

To assure the continued privacy and confidentiality of your personal financial information, your bank observes these practices and procedures:

We collect nonpublic information about you from some or all of the following sources:

·       Information we receive from you on applications or other forms;

·       Information about your transactions with us, our affiliates, or others; and,

·       Information we receive from a consumer reporting agency.

(c) Information We Disclose
We do not disclose any nonpublic personal information about our customers and former customers to affiliates or non-affiliated third parties except as permitted by law.

(d) Our Security Measures
We restrict access to nonpublic information about you to those employees who need to know that information to provide products or services to you. We maintain physical, electronic and procedural safeguards that comply with Federal regulations to guard your nonpublic personal information.
